Article 1 : Reservations

Passengers must reserve their excursion in advance.

Any special health condition must be declared at the time of booking, as stated in article 6-2.

Pregnant women and people with disabilities or physical or health problems of any kind must declare this at the time of booking.

It is preferable to make your reservation as early as possible, given the limited number of places on board the ship and the high number of passengers, especially during the high season.

The company accepts online bookings via its website www.nissacroisieres.com, by telephone, or directly at the point of sale.

Any reservation without immediate payment will only be validated once a credit card imprint and valid contact details have been provided.

In all cases, the customer will be required to pay for the ticket following this reservation, in accordance with the conditions set out in article 4 herein.

Children under the age of 5 are allowed on board only if accompanied and under the responsibility of their parents.

Pets are not allowed on board.

Article 2 : Excursion schedules, itineraries and prices

The company offers its passengers several tours throughout the day, at different rates.

Schedules and itineraries are defined by Nissa Croisières. The website as well as the brochures, billboards and posters published by Nissa Croisières and presenting the tours do not constitute a contractual document. The information provided is for guidance only. Programs may be subject to change.

Schedules and itineraries may change during the season, depending on the weather, the temperature, sunrise and sunset times, and the opening hours of establishments (ports, restaurants, etc.) that can accommodate passengers on excursions.

As with timetables and itineraries, fares may vary at any time depending on the elements or the economic situation (surcharges, fuel, etc.) or changes in taxes (VAT, port and custom taxes).

Fares do not vary according to the number of passengers.

Prices include all taxes.

Passengers will be informed of timetables, routes and fares at the time of booking via the website or after contacting the Company for information.

However, departure and arrival times announced at the time of booking may be brought forward or delayed in the event of any difficulty encountered by the ship’s captain.

In addition, weather conditions may force the ship’s captain to modify the excursion route originally planned.

In any event, passengers will be kept informed of any changes to schedules, fares or itineraries.

Under no circumstances will such changes justify the payment of any compensation to passengers.

The carrier reserves the right, at the Captain’s discretion and for reasons inherent to navigation, to make stopovers other than those planned, or to modify the initial route.

The Captain is authorized to tow, to rescue vessels in all situations, to divert, to carry out all rescues and all transshipments.

Neither the Captain nor the Company can be held responsible for diversions, modifications, service interruptions or delays in ship departures and arrivals, or for the non-coincidence of ship arrivals, departures or connections with aircraft and trains.

Article 3 : Cancellation

3.1- Cancellation by the Company

The company reserves the right to cancel an excursion, without notice or compensation, if the minimum passenger quota is not reached (8 full-fare passengers), in the event of force majeure, unforeseen circumstances, adverse weather conditions, damage, malfunction of any kind, for safety reasons or for any other legitimate reason.

Only the ship’s captain is authorized to judge whether or not weather conditions allow the excursion to go ahead, always with the aim of enabling passengers to enjoy a visit in the best possible conditions.

If the ship’s departure is prevented or delayed by one of these exceptional events, the company declines all responsibility for any direct or indirect costs or damage caused to passengers.

Nissa Croisières undertakes to inform passengers as soon as it is aware of any difficulty affecting or preventing the excursion from taking place.

The company will do its utmost to offer passengers an alternative, in particular the postponement of the excursion, depending on the company’s availability, without passengers being able to claim any compensation, reimbursement or indemnity.

If no alternative solution is proposed or accepted, passengers may claim a full refund of their tickets from the Company.

Refunds will be made by the same method of payment used by the passenger at the time of booking.

 

3.2- Cancellation by the passenger

Passengers may cancel their reservation for any reason and at any time.

However, they will only be reimbursed or exempted from payment of their ticket if the cancellation is made at least 48 hours before the excursion departure time.

Failing this, the passenger will be required to pay the full cost of the ticket, and the Company will not be liable for any refund or compensation.

 

3.3-Group cancellation

A group may cancel its reservation for any reason and at any time.

However, they will only be reimbursed or exempted from payment of their ticket if the cancellation is made at least 96 hours before the excursion departure time.

Failing this, the passenger will be required to pay the full cost of the ticket, and the Company will not be liable for any refund or compensation.

Article 4 : Terms of payment

Ticket payment is made at the time of booking.

The company accepts payment by e-transaction, credit card, ANCV vacation vouchers or cash.

Passengers can pay for their ticket directly online on the company’s website, or at the main ticket office in Nice’s Port during opening hours.

Tickets can also be paid for on board by credit card, cheque, ANCV vacation voucher or cash.

A valid e-mail address is required at the time of booking, in order to receive your electronic ticket. The validity of the e-mail address is the responsibility of the customer.

Tickets are only issued against full payment.

Change is not given on vacation vouchers.

Article 5 : Validity and non-transferability of securities

Tickets are valid for the current season.

They are not transferable.

Article 6 : Embarkation and disembarkation

6.1 – Boarding conditions

Passengers must present themselves in front of the boarding area 20 minutes before departure, for those without a ticket, and 10 minutes before for those with a dematerialized ticket.

No delays are accepted by the company.

In the event of delay, even with a ticket, passengers have no recourse against the company if they are unable to board.

Passengers embark and disembark in the presence of the captain, who directs the passengers and instructs them on how to board and disembark.

Only passengers who have reserved their place and show a valid ticket are allowed to board.

The ticket must be kept in good condition by the passenger for the duration of the journey.

The company reserves the right to refuse boarding to any passenger or group of passengers presenting themselves for boarding without a reservation or ticket.

The Captain is also empowered to refuse boarding to anyone whose physical or mental condition does not allow them to take the trip, or to anyone who has taken narcotics, hallucinogens or alcohol which makes them dangerous to other passengers. In all the cases listed above, the passenger will not have the right to evade responsibility for any damage caused to his or her person, to the ship, to property and equipment, to third parties or to the property of third parties.

6.2 – Passenger’s state of health

Any particular state of health must be declared at the time of booking.

In addition, any passenger with a disability, a proven health problem, or physical conditions incompatible with the proposed trip (pregnant woman, passenger with a back problem, person with reduced mobility or a severe disability, or with a high heart rate, etc.) is required to notify the company at the time of booking, as indicated in article 1.

In the event of non-declaration at the time of booking, the Captain may refuse boarding to passengers whose state of health is incompatible with the excursion, without being able to demand reimbursement or compensation of any kind from the passenger.

The captain is not obliged to embark a passenger who has not mentioned his or her condition under these conditions.

Such passengers will still be required to pay their ticket, and no refund or compensation will be possible.

In addition, if the captain deems that the health or physical condition of a passenger who has duly reported his or her condition is incompatible with the trip in view of the day’s weather conditions, he or she is entitled to refuse the passenger boarding.

In this case, the passenger will be refunded in full.

 

6.3 – Accessibility

This type of boat is incompatible with the transport of persons with reduced mobility or severe physical disabilities. In the event of non-declaration at the time of booking, the Captain is empowered, among other things, to refuse boarding to passengers whose disability is incompatible with the excursion, without being able to demand reimbursement or compensation of any kind whatsoever, as defined in article 6.2.

Bicycles, baby carriages, baby carriages (even folded), motorcycle equipment or other bulky items are not allowed on board and cannot be taken on board.

Article 7 : Safety instructions and liability

The captain is the sole master of his ship and informs passengers of the safety instructions to be followed.

Passengers are required to remain seated during navigation.

They may only move around the ship with the authorization of the captain.

Minors are allowed on board if accompanied by their parents, and remain under the latter’s full supervision and responsibility.

Animals are not allowed on board.

Passengers agree in all cases to abide by the rules and regulations established by Nissa Croisières on board its ships, and to obey the Captain’s orders.

In the event of an accident resulting from passengers’ failure to comply with safety instructions, the Company cannot be held responsible for any damage that may occur.

Passengers are required to keep their personal belongings with them.

The company is not responsible for objects on board, damage to property or personal effects (jewelry, precious metals, personal papers and documents, sound or image reproduction equipment, cell phones and glasses).
In the event of theft, loss or damage of these items, no compensation, refund or indemnity will be made.

Article 8 : Swimmings

Nissa Croisières is not a diving or snorkeling club.

However, we do offer swimming breaks during our excursions.

Passengers are responsible for their own swimming.

The captain reserves the right to cancel a swim break due to weather conditions.

Passengers agree in all cases to abide by the rules established by Nissa Croisières on board its ships, and to obey the Captain’s orders.

Article 9 : Stopovers

The Vessel may offer its passengers stopovers during excursions.

The Company is not responsible for passengers and their personal belongings during these stopovers.

Swimming equipment is available for loan during these stopovers.

The Company cannot be held responsible for any difficulties encountered by passengers at a shop or establishment during the stopover.

The captain will provide passengers with a schedule for the end of the stopover and return to the ship.

Passengers must arrive at the ship 5 minutes before the departure time given by the captain.

No refund or compensation can be demanded from passengers who are unable to embark due to delay.

Article 10 : Ship regulations

Nissa Croisières boats are subject to European passenger transport regulations.

Navigation license, renewed after annual inspection, attesting to the vessel’s compliance with technical standards relating to passenger ship safety (stability, buoyancy, strength, fire prevention and extinction, life-saving appliances, etc.).

The captain holds a Brevet de Commandement and a Brevet de Chef Mécanicien.

These Brevets also imply possession of a first-aid training certificate, and a CGO certificate (Certificat radio d’opérateur).

All crew members are required to undergo an annual medical examination by a seafarers’ physician.

Special insurance covering all passengers.

Article 11 : Groups, Convention and Privatization

11.1 – Booking conditions

The reservation of a privatization service, or for a group, will only be effective after the customer’s acceptance of the quotation and after payment of a deposit equal to 40% of the total amount of the service.

The remaining amount must be paid at the latest before boarding.

In the event of cancellation on the part of the customer, the amount of the deposit remains due to the company, and the customer will not be entitled to any reimbursement or compensation.

In the event of cancellation by the company under the conditions described in article 3.1, the full amount will be refunded to the customer.

 

11.2 – Groups and conventions

Preferential rates are granted to groups of at least 10 people.

Payment will be made according to the terms and conditions defined in article 11.1.

Refunds are subject to the company’s cancellation policy as defined in article 3.1. Cancellation conditions on the part of the customer are defined in article 3.3.

Within the framework of agreements or conventions established between Nissa Croisières and partners, their members or customers may benefit from discounts granted by Nissa Croisières.

At embarkation, passengers must provide proof of their stay or membership with one of our partners, in which case the full amount of the ticket will be due at the current rate, without any recourse to Nissa Croisières.

The establishment of an agreement does not allow third parties or signatory third-party organizations to replace Nissa Crosières’s general terms and conditions of sale.

Article 12 : Claims

Any complaint against Nissa Croisières must be made within 15 days of the date of the excursion, by registered letter with acknowledgement of receipt to the head office of Nissa Croisières, 58A chemin gino niccolai, 06100 Nice.
